7. PERSONAL DATA MANAGEMENT.

The Customer is informed of the regulations concerning marketing communications, the law of 21 June 2014 for Trust in the Digital Economy, the Law on Information Technology and Freedom of 6 August 2004 as well as the General Regulation on Data Protection (GRDP: nr.2016-679).

7.1 Persons responsible for the collection of Personal Data

For Personal Data collected in the context of the creation of the User’s personal account and his navigation on the Website, the entity responsible for processing the Personal Data is: BIOBank. BIOBank  is represented by Mr Joucla, its legal representative.

As the party responsible for processing the data he collects, BIOBank undertakes to comply with the legal provisions in force. In particular, he must establish the purposes of its Data processing, provide its prospects and Customers, from the time of collection of their consent, with full Information on the processing of their Personal Data and maintain a logbook of the processing in accordance with the reality. Whenever BIOBank processes Personal Data, BIOBank takes all the reasonable steps to ensure that the Personal Data is accurate and relevant to the purposes for which it is processed. 7.2 may process all or part of the Data:

• to enable navigation on the Website and the management and traceability of services ordered by the User: connection and Website usage Data, invoicing, order history, etc.• to prevent and fight against computer fraud (spamming, hacking…): computer equipment used for navigation, IP address, password (hashed)
• to improve navigation on the Website: connection and usage Data
• to conduct optional satisfaction surveys on BIOBank: e-mail address
• to conduct communication campaigns (texts, e-mail): phone number, e-mail address

BIOBank does not trade your Personal Data which is therefore only used for statistical and analytical purposes.

7.3 Right of access, rectification and opposition

In accordance with current European regulations, BIOBank Users have the following rights:
• access rights (Article 15 GRDP) and rectification (Article 16 GRDP), right to update, complete User Data, the right to block or delete User Data of a personal naturel (Article 17 GRDP), where such Data is inaccurate, incomplete, ambiguous, misleading or where its collection, use, communication or storage is prohibited
• rights to withdraw consent at any time (Article 13-2c GRDP)
• right to limit the processing of User Data (Article 18 GRDP)
• right to object to processing of User Data (Article 21 GRDP)
• right to portability of data provided by Users, where such Data are subject to automated processing based on their consent or on a contract (Article 20 GRDP)
• Right to define the fate of User’s Data after their death and to choose to whom BIOBank should communicate (or not) their Data to a third party that they have previously designated.

As soon as BIOBankbecomes aware of the death of a User and in the absence of instructions from the UserBIOBank  undertakes to destroy the User’s Data, unless it is necessary to keep it for evidentiary purposes or to comply with a legal obligation.

If the User wishes to know how BIOBank uses his/her Personal Data, to ask to rectify them or to oppose their processing, the User can contact BIOBank in writing at the following address:

In this case, the User must indicate the Data he wishes BIOBank to correct, update or delete, identifying himself precisely with a copy of an identity document (identity card or passport).

Requests for deletion of Personal Data will be subject to the obligations imposed on BIOBank by law, in particular as regards the conservation or archiving of documents. Finally, users may lodge a complaint with the supervisory authorities and in particular with the CNIL BIOBank

7.4 Non-disclosure of Personal Data

BIOBank  will not process, host or transfer Information collected about its Customers to a country outside the European Community or recognised as “unsuitable” by the European Commission without prior notification to the Customer. However, BIOBank  remains free to choose its technical and commercial subcontractors on condition that they present sufficient guarantees with regard to the requirements of the General Regulation on Data Protection (GRDP: nr.2016-679).

BIOBank undertakes to take all necessary precautions to preserve the security of the Information and in particular to ensure that it is not communicated to unauthorised persons. However, if an incident impacting the integrity or confidentiality of the Customer’s Information is brought to BIOBank’s attention, BIOBank must inform the Customer as soon as possible and inform him of the corrective measures taken. Furthermore,BIOBank

does not collect any “Sensitive Data”. The User’s Personal Data may be processed by BIOBank subsidiaries and subcontrators (service providers), exclusively for the purposes of this policy.

Within the limits of their respective attributions and for the purposes mentioned above, the main persons likely to have access to the Data of BIOBank Users are mainly the agents of our Customer service.
